    Race or colour

    "Race" is a way of classifying humans according to physical or cultural criteria, without a scientific basis.

    A person cannot discriminate or harass you because of your "race" or the colour of your skin.

    In fact, the Charter of Human Rights and Freedoms prohibits everyone to:

    • treat you differently because of your race or skin colour
    • make repeated offensive comments related to your race or skin colour
    • have repeated offensive behaviour towards you related to your race or skin colour.

    Race and colour are often interrelated grounds of discrimination and both relate to the notion of racism. Racial profiling is also a form of discrimination based on race or colour.

    Discriminated against while trying to enter a bar

    Dominique, a 23-year-old student living in Brossard, sometimes, goes out to South Shore bars with his friends, male and female. Doormen often don’t let the males in claiming that in previous weeks, Blacks were involved in fights. Doormen are not allowed to treat Dominic this way, it is discrimination based on race or color.

    Racial profiling by the police

    Maria was stopped while driving home. The police checked to see if the car belonged to her and said she had run a red light. Yet there are no traffic lights on the road from Maria’s church to her house. Upon verification of this, the police were forced to admit that they were wrong, but told Maria, “We’ll ticket you next time.” The police are not allowed to treat Maria as though she is guilty when they have no evidence. This is discriminatory profiling.
