Abuse or exploitation of the elderly? Better understand these concepts in order to address a major issue

A new opinion of the Commission explains what is exploitation under the Charter of Human Rights and Freedoms and what is abuse under the Act to combat maltreatment of seniors and other persons of full age in vulnerable situations. By presenting the convergences and divergences between these two concepts, the Commission aims to better ensure respect of the rights of people in vulnerable situations. ​

Montréal, February 5, 2019 – More than one-third of the judgments rendered in 2018 by the Human Rights Tribunal concerned an alleged situation of exploitation of an elderly or disabled person. In judgments confirming a situation of exploitation, a total of nearly half a million dollars ($474 001) was paid to the victims or to their estate. A new opinion of the Commission explains what is exploitation under the Charter of Human Rights and Freedoms and what is abuse under the Act to combat maltreatment of seniors and other persons of full age in vulnerable situations. By presenting the convergences and divergences between these two concepts, the Commission aims to better ensure respect of the rights of people in vulnerable situations.
