Application and Interpretation of Section 18.1 of the Charter of Human Rights and Freedoms

This legal opinion explains the scope and application of Section 18.1 barring an employer from collecting information related to one of the 13 prohibited grounds for discrimination as set out in the Charter of Human Rights and Freedoms (s. 10), whether in employment interviews, in a pre-employment forms or in a medical examinations. The purpose of this section is to prevent employment discrimination at its source.
