Equal access to employment programs are designed to counter systemic discrimination in employment. They are implemented by public bodies, certain businesses and certain government agencies.

Systemic discrimination in employment is when, due to systems in place, members of certain groups experience:

  • unequal employment opportunities
  • lower wages
  • limited prospects for promotion

The system may appear neutral at first glance, but in application, it may disadvantage or exclude some people. Just because systemic discrimination isn’t intentional doesn’t mean it isn’t discrimination.


An equal access to employment program cannot require a public body to:

  • hire or promote unqualified people
  • take actions that would harm people who do not belong to a protected group
  • ignore seniority
  • create new positions


The self-identification questionnaire

A self-identification questionnaire is used by employers to implement an Equal Access to Employment Program in their organization or business. It allows people applying for a job or already employed to identify themselves as belonging to one or more of the groups targeted by the program in order to ensure equitable representation in employment of women, persons with disabilities, Indigenous peoples, visible minorities and ethnic minorities. The information collected by this questionnaire is confidential.
